Terms of Service

1. Who these terms apply to

These terms govern any package purchased through bestdaydesigned's website (bestdaydesigned.com), operated from Mulzerstraße 17, 85051 Ingolstadt-Haunwöhr, Germany, and any scoping call or direct engagement arranged through the Contact page.

2. The services

bestdaydesigned sells fixed-scope, packaged design services (Website Design, E-Commerce Design, Web App / Product Design, Branding & Identity, Landing Page Design) and a recurring Website Care Plan, exactly as described and priced on /pricing and each service page at the time of order. Package inclusions, revision-round counts, and turnaround ranges stated on the relevant service page at checkout form part of the agreed scope.

3. Ordering and payment

Packages are ordered through the site's cart and checkout. All prices are shown excluding 19% German VAT, which is added at checkout and itemised on your invoice. For one-off packages, a 50% deposit is due at order confirmation, with the remaining balance due before final files are released. For the recurring Website Care Plan, the full monthly fee is billed at the start of each billing period. At present, this site's checkout is a demonstration flow — see the "Demo checkout" notice at checkout; real orders are confirmed directly by email once a deposit or payment method has been arranged. This does not change the terms that will apply once payment processing is live.

4. Scope changes

Work proceeds according to the inclusions of the ordered tier. If a project needs work beyond that scope — extra pages, extra revision rounds, a larger product catalogue, and so on — bestdaydesigned will flag it and provide a price for the additional scope before doing the extra work. No additional charges are applied without your agreement first.

5. Revisions

Each package includes a stated number of revision rounds (see the relevant service page). A round consists of one consolidated set of feedback on the current concept. Revisions beyond the included rounds are billed at the studio's standard hourly rate, quoted before starting.

6. Timelines

Turnaround ranges stated on each service page assume feedback is returned within a few business days at each revision round. Slower feedback extends the timeline in proportion; it does not change the agreed price or scope.

7. Intellectual property

Ownership of final design files transfers to the client on receipt of full payment. Until full payment is received, all design work remains the property of bestdaydesigned. Unless otherwise agreed in writing, bestdaydesigned retains the right to display completed work in its own portfolio and on /work.

8. Client-provided content

Clients are responsible for the accuracy, rights, and legality of any content, images, logos, or trademarks they supply for use in a project. bestdaydesigned is not liable for infringement arising from client-supplied material.

9. Cancellation

10. Liability

bestdaydesigned's liability for any claim relating to a project is limited to the amount paid for that specific package. bestdaydesigned is not liable for indirect or consequential losses, including lost revenue or lost business opportunity, except where liability cannot be limited by law (e.g. gross negligence, injury, or wilful misconduct).

11. Governing law

These terms are governed by the law of the Federal Republic of Germany. Where a dispute involves a consumer, mandatory consumer-protection provisions of the consumer's home country within the EU may also apply.

12. Changes to these terms

bestdaydesigned may update these terms from time to time; the version in force at the time of your order applies to that order. The "last updated" date above reflects the most recent revision.
